01Who we are
Digital Mart (“we”, “our”, or “us”) is the trading name of FUSION GADGETS ELECTRONICS TRADING L.L.C., a limited liability company licensed by the Dubai Department of Economic Development, with registered offices at Zarooni Building, Office 401, Al Marrar, Deira, Dubai, United Arab Emirates.
We are the “Data Controller” under UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (the “PDPL”). This means we decide why and how your personal information is processed when you visit digitalmart.ae, place an order, or communicate with us. This policy explains what we collect, the purposes and legal bases for processing it, who we share it with, how long we keep it, and the rights you have over it.
This policy applies to our website, our WhatsApp and telephone sales channels, and our in-store transactions where personal information is recorded. By using our services, you acknowledge the practices described here. If you do not agree with this policy, please discontinue use of our services and contact us with your concerns.
02Information we collect
Information you provide directly
- Identity and contact details: full name, phone number, email address, and Emirates or delivery address provided at checkout or in-store.
- Order details: products purchased, serial numbers or IMEI of devices registered for warranty, order value, and any delivery instructions you give us.
- Payment confirmation: we record that a payment was completed, the method used, and the transaction reference. We do not see or store your full card number.
- Communications: messages, call notes, and voice recordings (where lawfully made and disclosed to you) when you contact us by WhatsApp, email, or phone.
- Warranty and after-sales records: service requests, repair history, and returns documentation.
Information collected automatically
- Technical data: device type, operating system, browser version, screen size, and approximate location derived from IP address (city level).
- Usage data: pages visited, products viewed, time on site, and referring website, collected through cookies and similar technologies described in Section 05.
What we deliberately do not collect
We do not request or process sensitive categories of personal data under Article 5 of the PDPL (such as health data, biometric data, or data revealing religious beliefs). Please do not send us such information, as we have no lawful basis to process it.
03How we use your information
We process personal data only for specific, explicit, and legitimate purposes, and only to the extent necessary for those purposes. The list below sets out what we do and why the law allows it.
Processing activities and purposes
- Order fulfilment. Processing your purchase, arranging delivery, confirming payment, and providing order updates. This is necessary to perform the sales contract with you.
- Warranty and after-sales service. Registering your device warranty, handling repairs, returns, and replacements under UAE consumer protection law. This is necessary to perform the contract and to comply with our legal obligations.
- Customer support. Answering questions before and after purchase, including via WhatsApp. This is necessary for the contract and based on our legitimate interest in serving customers.
- Legal and tax compliance. Maintaining invoices and transaction records as required by UAE tax and commercial regulations, and responding to lawful requests from competent authorities.
- Fraud prevention. Verifying orders, detecting stolen cards or devices, and screening for abuse. Based on our legitimate interest in protecting our business and customers.
- Website improvement. Analysing anonymised usage patterns to improve navigation, speed, and product presentation. Based on legitimate interest; you may object at any time.
- Marketing. Sending offers and new-arrival alerts only where you have opted in, as described in Section 08. Based on your consent, which you may withdraw at any time.
We do not use your personal data for automated decision-making that produces legal or similarly significant effects, and we do not engage in profiling beyond anonymised aggregate analytics.
04Sharing and third parties
We share personal information only with the parties below, only to the extent each service requires, and under written obligations consistent with this policy. We never sell personal data, and we never share it for other companies’ marketing.
Categories of recipients
- Payment processors. Transactions are processed by PCI-DSS certified gateways (for example, PayTabs, Stripe, or Telr, depending on the method selected). Your card details are entered on the gateway’s secure page and are never transmitted to or stored on our servers.
- Buy-now-pay-later providers. If you choose Tabby or Tamara instalments, your application data is processed by that provider under its own privacy policy to assess eligibility. We receive only the approval status and instalment schedule needed to complete your order.
- Courier and logistics partners. Licensed UAE delivery companies receive only your name, phone number, and delivery address to perform the delivery.
- Warranty service centers. Authorized manufacturer service centers receive your device details and proof of purchase when you make a warranty claim.
- Platform providers. WhatsApp (Meta) processes messages you send us under its own terms; our website hosting and analytics providers process technical data under data processing agreements.
- Public authorities. We disclose information when required by UAE law, court order, or a competent regulatory authority, and only to the extent legally required.
International transfers
Some of our service providers (such as Meta for WhatsApp, or cloud hosting providers) process data outside the UAE. Where this occurs, we rely on appropriate safeguards consistent with the PDPL, including contractual protections and, where applicable, adequacy decisions or your explicit consent for the specific service you choose to use.
05Cookies
Cookies are small text files stored on your device. We use a minimal set, grouped as follows:
Essential cookies
These keep your shopping cart, checkout session, and security tokens working. They cannot be disabled without breaking core store functions such as adding items to your cart.
Functional cookies
These remember preferences such as currency (AED), language, and recently viewed products, so the store feels consistent between visits.
Analytics cookies
We use privacy-respecting, aggregate analytics to understand which pages perform well. These do not identify you personally, and we do not use third-party advertising or cross-site tracking cookies.
Managing cookies
You can block or delete cookies through your browser settings at any time. The store will remain functional, though you may need to re-select preferences and your cart may not persist between visits. By continuing to use the site with cookies enabled, you consent to the use described above.
06Retention and security
How long we keep your data
- Order and invoice records: retained for at least five years from the transaction date, as required for UAE tax and accounting purposes, after which they are securely deleted or anonymised.
- Warranty and service records: retained for the duration of the warranty period plus the applicable limitation period for consumer claims.
- Marketing data: retained until you withdraw consent or unsubscribe, whichever comes first.
- Support correspondence: retained for up to twelve months after the matter is resolved, unless a longer period is needed for an ongoing claim.
- Technical logs: retained for a maximum of ninety days, then aggregated or deleted.
How we protect it
We apply technical and organisational measures appropriate to the risk, including HTTPS encryption on all pages, access controls limiting personal data to staff who need it for their role, regular software updates, and confidentiality obligations for all employees and contractors.
In the unlikely event of a personal data breach likely to result in a risk to your rights, we will notify the UAE Data Office and affected individuals in accordance with Articles 22 and 23 of the PDPL, without undue delay.
07Your rights
Under the PDPL, you have the following rights regarding your personal data. To exercise any of them, contact us using the details in Section 10. We will verify your identity and respond without undue delay and in any event within a reasonable period.
- Right of access. To obtain confirmation of whether we process your data and a copy of it.
- Right to rectification. To correct inaccurate or incomplete personal data.
- Right to erasure. To request deletion of your data where it is no longer necessary for the purposes it was collected, or where you have withdrawn consent, subject to legal retention obligations.
- Right to restriction of processing. To limit how we use your data while a concern is being resolved.
- Right to object. To object to processing based on legitimate interests, including direct marketing, which we will stop immediately.
- Right to data portability. To receive your data in a structured, commonly used format where processing is based on consent or contract and carried out by automated means.
- Right to withdraw consent. Where processing is based on your consent (such as marketing), you may withdraw it at any time without affecting the lawfulness of processing before withdrawal.
- Right to complain. You may lodge a complaint with the UAE Data Office if you believe your data has been processed unlawfully.
08Marketing communications
We send promotional messages (offers, price drops, new arrivals) only where you have actively opted in, typically through a checkbox at checkout or a sign-up form. Marketing by WhatsApp or email always originates from us and never from third parties on our behalf.
Every marketing message includes a clear, free way to opt out: an unsubscribe link in emails or a reply option in WhatsApp. You can also ask us at any time via the contact details in Section 10. Opting out stops marketing immediately but never affects order confirmations, receipts, warranty correspondence, or support, which are transactional and required to serve you.
09Changes to this policy
We may update this policy from time to time to reflect changes in our practices, our services, or applicable law. When we do, we will revise the “Last updated” date at the top of this page.
For material changes, such as new categories of data sharing or new processing purposes, we will notify customers who have ordered from us by email or WhatsApp before the change takes effect, and where the law requires it, we will obtain your consent. We encourage you to review this page periodically. Continued use of our services after an update constitutes acceptance of the revised policy.
